Somnul

These terms govern your use of Somnul (the "app"), published by OOTSSU. By using the app you agree to them.

What Somnul is

Somnul measures sound while you sleep and gives you a report in the morning: a score out of 100, a timeline from bedtime to wake, and the runs of noise it detected. It is a measurement and curiosity tool — something to find out what you sound like at night.

What Somnul is not

Somnul is not a medical device. It does not diagnose, treat, cure, or prevent any condition, and it does not screen for sleep apnoea or any other sleep disorder. A high score is not a finding, and a low score is not reassurance. If you are worried about your breathing during sleep, your daytime tiredness, or anything else about your health, speak to a qualified healthcare professional. Do not use this app in place of that conversation, and do not use it to decide whether to seek or stop treatment.

The limits of the measurement

A phone microphone is not a calibrated instrument, and these limits are real rather than legal boilerplate:

• Loudness is measured relative to the background noise of your room, not as an absolute sound level. Somnul deliberately does not report decibel figures it cannot honestly claim.
• Results change with where the phone sits, what it is resting on, and how far away you are.
• A fan, an air conditioner, traffic, or a partner can be measured as noise. Somnul cannot tell whose sound it is or what made it.
• Sustained noise that never pauses is treated differently from the pulsing pattern of snoring, but no detection is perfect in either direction.

Recording other people

If you share a room, tell the other person that you are recording and get their agreement before you start. Depending on where you live, recording someone without their knowledge may be unlawful. You are responsible for that; we have no way to know who is in the room.

Your purchase

Somnul is unlocked by a single, one-time purchase through the App Store. It is not a subscription: it does not renew, nothing is charged again, and there is nothing to cancel. The price for your region is shown in the app before you buy, and payment is charged to your Apple Account when you confirm it.

The purchase is tied to your Apple Account, not to a device. On a new phone, or after reinstalling, use Restore purchase on the payment screen or in Settings to unlock it again at no further cost.

Refunds are handled by Apple under the App Store Terms of Service. We cannot issue them ourselves; requests go through reportaproblem.apple.com.

Recordings are yours, and they are only on your device

What Somnul records stays in the app's storage on your phone. We have no copy, which also means we cannot recover anything for you — if you delete a night, delete the app, or lose the device, that data is gone. Somnul is not a backup service. Audio is also deleted automatically once the retention period you set in Settings has passed.

Using the app as intended

Please do not attempt to defeat the purchase check, reverse engineer the app beyond what the law permits regardless of a contract term, or use it to record people who have not agreed to it.

Availability and changes

We may change how Somnul works, and features may be added or removed in future versions. We may stop publishing the app. Nothing here guarantees the app will keep working with future versions of iOS. Because the purchase is one-time rather than a subscription, you are not being charged for a future period of service.

No warranty, and the limit of our liability

Somnul is provided as it is, without warranty of any kind, including any warranty that its measurements are accurate or suitable for any particular purpose. To the fullest extent the law allows, OOTSSU is not liable for indirect or consequential loss arising from your use of the app, and our total liability is limited to what you paid for it.

Nothing in these terms removes rights you have under consumer law where you live, and nothing here limits liability that cannot lawfully be limited.
